By law, notaries can't provide documents or advise which document to use. We can however print them for you if emailed to us.
If you had a name change or if you go by a different name and your ID doesn't match your name on the document, we can still proceed with the notarization as long as the notary can reasonably determine that you are indeed the same person on the ID and document. Call for details.
Anyone can be a witness as long as they don't have a beneficial interest in the document. They don't need to know the signer of the document, nor do they need to provide an ID. They just watch the person sign the document and then sign and print their name and address. If you don't have access to a witness, we can provide one for an additional $25. In the state of CA, notaries can both notarize and witness the same document.
A Notary Public is a public official appointed by the Secretary of State to be an impartial witness to the signing of important legal documents. Our job is to deter fraud. We verify the identity of the signer, their willingness to sign the document, and their understanding of the document.
A Notary Public confirms the identity, awareness, and willingness of the person signing the document. Some notarizations require the notary to put the singer under oath, where the signer swears under the penalty of perjury that the content of the document is true.
Yes! Documents written in a foreign language can be notarized in California as long as the person signing the document can communicate in the same language as the Notary Public. The Notary certificate must be in English and can be provided by the Notary.
The Notary Public must be able to directly communicate with the signer. The use of a translator is prohibited. We only provide notarizations for English speaking clients.
The signer must have mental capacity. This means that they must have the ability to make a decision, as well as understanding, remembering, and communicating that decision to another person. A Notary can refuse to notarize a document if they feel that the signer lacks mental capacity.
The Notary will use their best judgement in determining mental capacity. This is most likely accomplished by a conversation between the signer and the Notary. Sometimes the Notary may ask to speak with the signer alone (without the influence of family or friends). The Notary should look for warning signs such as, incoherent communication, confusion, being unaware, or unwilling.
